VACATION RENTAL POLICIES

PAYMENTS

Deposit Payment: The deposit payment of 1500 is due by credit card at the time of reservation. If payment is not received by the due date Allure Kauai Vacation Services (AKVS) reserves the right to cancel the reservation with no further notice.  

Payment: The full balance (rent and fees) is due no later than ninety (90) days prior to check-in date. If you are booking within 90 days, but outside of 14 days of arrival we will allow a check payment for the balance. Post dated checks not accepted. If your arrival date is within 14 days from booking date you must pay via credit card or money wire within 48 hours. Personal check not an option. We must have a valid credit card on file. If payment is not received by the due date Allure Kauai Vacation Services has the right to cancel the reservation and retain such fees as provided below, and deposit payments. All credit card payments is subject to an additional 3.5% credit card processing fee. Over payments not accepted.

Security Deposit: Allure Kauai Vacation Services will keep Guest’s credit card information on file, and Guest authorizes Allure Kauai Vacation Services to charge Guest’s credit card if the final check payment has not been received by the due date, and for additional charges such as, but not limited to; any loss or damage to rental property, excessive cleaning/laundry or rearranging furniture that has been moved, costs to replace keys or  for unreturned keys ($75) , replacement of missing items from unit, unusual soiling of towels/linens/carpets, unauthorized telephone/cable charges, any cost of cleaning beyond the normal out clean fee, misuse of items belonging to the property, exceeding number of guests which is listed on the rental contract, smoking on premises and unauthorized extension of lease term, etc. in excess of the refundable security deposit and/or damage protection plan, if applicable. Guest will be charged a minimum of $35/hr for time spent by Allure Kauai Vacation Services to replace such damaged item(s), in addition to the cost of the damaged or lost item(s). Should the damages and/or missing inventory costs exceed the balance of your Security Deposit, Guests agrees to promptly pay any such excess.

Cancellations/Changes: All cancellations are subject to a $750 service charge. All cancellations and/or changes must be made in writing (fax or email acceptable). If applicable, all changes are subject to approval by agent and will incur a $100-$200 fee for each change.  No changes can be made to the reservation within 120 days of arrival.  For cancellations less than 90 days of your check-in date, Guest’s full rent and taxes will be forfeited. If applicable, reservation fee and reservation card processing fees are non refundable.  Purchase of travel insurance is highly recommended. 

RENTAL TERMS

Guest acknowledges that when, due to circumstances beyond Allure Kauai Vacation Service’s (AKVS) control, the reserved Property becomes listed for sale, change of ownership, unavailable or uninhabitable, substitute accommodations will be offered.  If this is not possible, the Owner or Allure Kauai Vacation Services cannot provide the Property in a fit and habitable condition or substitute a reasonable comparable property, the limit of liability of the Owner and Allure Kauai Vacation Services is to refund any payments received from Guest. Rental rates and fees are subject to change at any given time.

Guest understands that a Vacation Rental Home is not a hotel, and, therefore, 24-hr maintenance and assistance is not available.  Allure Kauai Vacation Services will do it’s best to take care of any issues and/or repairs and will have maintenance e to the property within 24 hours.  

Guest agrees to allow Allure Kauai Vacation Services and it’s contractors, agents, etc. the right to enter property for any of the following purposes: a) to make repairs or replacements; b) to supply requested services; c) if property is listed for sale, to show the property at a reasonable time with 48 hours advance notice to Guest; d) in case of an emergency the right to enter anytime for the purpose of safekeeping or prevention of damage to the property.  

Property Manager’s Right To Enter 

a) To supply services agreed upon. b) If unit is for sale, we will give you 48 hours advance notice to show the unit at reasonable hours c) In case of an emergency, property manager reserves the right to enter at anytime for the purpose of safe keeping or prevention of further damage. Every effort will be made to contact tenants prior to entry. d) will not be liable for interruption of services provided by these appliances if for reasons outside of property manager control. e) will not be responsible for interruption of electricity, water, or gas for reasons outside of property manger control. f) Please promptly notify the property manager of any problems. Reasonable efforts to restore appliances and utilities to working order will be done as quickly as possible.  This agreement may not be terminated in the event of utility and/or appliance interruptions. 24 hour on island contact is Talia Abubo 808-826-4100.

Guest Responsibility

a) Guest is responsible for using their best efforts to familiarize themselves with property, its location, and surroundings. Some of the properties are in a remote location. As such, what would be considered normal response time for public services in an urban area may not be available in this location, i.e., police, fire, and emergency services. Also, naturally dwelling animals, reptiles and fauna are different then might be encountered in an urban setting and some might be considered “pests” by some individuals, including but not limited centipedes, geckos, roaches, spiders, rodents, termites, and mosquitoes. You should be prepared to accept such inconveniences or discomfort as a normal and necessary aspect of renting a home in a area with strong rural character. Also, Guest acknowledges this is a binding contract and cannot be released from the contractual obligations upon arrival. b) Notify us of any defects or problems. c) Use the unit as a place to live; you agree not to host an event, wedding, party or other gathering that exceeds the maximum occupancy displayed on the contract without prior written agreement with Allure Kauai Vacation Services. Violation may result in significant additional charges and forfeiture of your security deposit d) Furniture is not to be moved within or from the unit. e) No parties/functions within the rental property f) No animals/pets allowed in the unit or on the property g) No smoking within the unit. h) No shoes to be worn within the unit i.) Please obey all house rules posted in unit. j) Check in time 4 p.m. and check out time is no later than 10 a.m. k) Agrees to obey all house rules posted in the rental property. l) Property may not be sublet or assigned without prior written consent.  Any sublet or assignment without such consent shall be null and void. m) Guest acknowledges that Guest shall take precautions when leaving the property (lock windows, door, and vehicles). Should theft occur from either interior or exterior of the premises, the local Police should be called immediately to report the incident.  Guest is responsible to secure the property when leaving it vacant and at night.  Guests are advised to secure portable items of value in and out of sight location. n) Only those Guests listed in the agreement may stay at the Property. Guest agrees that under no circumstances shall the Property be used for illegal purposes.

Waiver and Release

Disclaimers: a) Housekeeping services may be available by request only and will incur additional fees b) This contract is binding and cannot be modified or terminated by a sudden change of circumstance c) Changes: The agent must be notified in writing of any changes as soon as possible for which there may be a service charge for each accepted change to the reservation d) You must leave unit on the date and time designated, unless prearranged, and any additional rent must be paid in advance e) Abandoned possessions: We will not be responsible for any of your personal effects left in the unit. We will be glad, if found, to mail them to you and have the right to deduct postage from your security deposit f) Guest hereby acknowledges the State of Hawaii is exposed to Tidal Wave/Tsunami/ Hurricane threat. g) We recommend Travelers Insurance for any unforeseen circumstances. Unfortunately we are not held responsible for any noise pollution including construction outside the perimeter of the property h) Weather in the State of Hawaii is unpredictable i) Agent acts solely as agent for Owner, the Owner has final authority concerning all matters.  Environmental Disclosure: Every person reacts differently to various pesticides, chemicals, and molds. Neighbors of the subject property may also use pesticides and chemicals that may affect a person that is sensitive to pesticides and other chemicals. Due to the tropical nature of Hawaii, many homeowners regularly use pesticides to combat pests in their home. If Guests are sensitive to pesticides, chemicals or molds, Guests are urged to investigate this issue prior to their arrival to Hawaii. Property managers are not experts in pesticides, chemicals or molds and not qualified to make recommendations or determinations concerning possible health or safety issues. Due to the tropical nature of Hawaii, owners and agents have no control over commonplace pests that may be exist on the property. These may include but are not limited to the following: geckos, centipedes, rodents, cockroaches, mosquitoes and ants.  Guests acknowledges, if applicable to Property, the existence of dangers associated with, but not limited to, hot tubs, BBQ’s, pools, saunas, gym equipment, rivers, lakes, beach gear and equipment, oceans, ponds, playgrounds, golf balls, lots, and ladders.  Guest acknowledges the existence of certain inherent risks to persons and property located in the vicinity of the ocean, including, but not limited to, high surf conditions, dangerous rip tides, coral reefs, hurricanes and tropical storms.  Guest acknowledges that the Owner will not rent the Property unless Guest fully accepts the risks associated with the Property unless Guest fully accepts the risks associated with Property and its location.  

GUESTS FOR THEMSELVES AND THEIR RESPECTIVE HEIRS, PERSONAL REPRESENTATIVES, SUCCESSORS AND ASSIGNS, HEREBY RELEASE ALLURE KAUAI VACATION SERVICES AND THEIR RESPECTIVE DIRECTORS, THE OWNER OF THE PROPERTY, OFFICERS, AGENTS, EMPLOYEES, SURETIES, INSURERS, INDEMNITOR, ATTORNEYS, SUCCESSORS AND ASSIGNS FROM ALL CLAIMS, DEMANDS, OR CAUSE OR THING WHATSOEVER RESULTING FROM OR IN CONNECTION WITH THE PROPERTY OF THIS RENTAL CONTRACT, INCLUDING WITHOUT LIMITATION ANY CLAIM, DEMAND OR CAUSE OF ACTION FOR PERSONAL INJURY OR DEATH AND ANY AND ALL LOSS, LIABILITY, COST AND EXPENSE RESULTING FROM ANY CLAIM, DEMAND, SUIT OR CAUSE OF ACTION WHICH MAY BE ASSERTED.
